Apple Inc. (NASDAQ:AAPL) lost a round in its fight with VirnetX Holding Corporation (NYSEMKT:VHC) when a federal judge denied Apple Inc. (NASDAQ:AAPL)’s motion for a summary judgement in the ongoing patent litigation. Benzinga elaborated on the court ruling in a recent article.
Apple Inc. (NASDAQ:AAPL) alleged VirnetX Holding Corporation (NYSEMKT:VHC) of using terms in the disputed patents that are too ambiguous and thus unenforceable for ‘indefiniteness’, which was denied by the U.S. District Court for the Eastern District of Texas. VirnetX Holding Corporation (NYSEMKT:VHC) has accused Apple Inc. (NASDAQ:AAPL) of infringing 16 of its networking patents. Apple Inc. (NASDAQ:AAPL) and VirnetX Holding Corporation (NYSEMKT:VHC) had presented their arguments on this and other motions in a ‘Markman’ hearing on May 20.
The recent judgement by the court on the motion precludes Apple Inc. (NASDAQ:AAPL) from using invalidity as a defense against infringement of the claims that were tried by a jury in an earlier litigation involving the company.
